Sunan at-Tirmithiy كتاب الفرائض باب ما جاء فى الذى يموت وليس له وارث

حَدَّثَنَا بُنْدَارٌ حَدَّثَنَا يَزِيدُ بْنُ هَارُونَ أَخْبَرَنَا سُفْيَانُ عَنْ عَبْدِ الرَّحْمَنِ بْنِ الأَصْبَهَانِىِّ عَنْ مُجَاهِدٍ وَهُوَ ابْنُ وَرْدَانَ عَنْ عُرْوَةَ عَنْ عَائِشَةَ أَنَّ مَوْلًى لِلنَّبِىِّ صلى الله عليه وسلم وَقَعَ مِنْ عِذْقِ نَخْلَةٍ فَمَاتَ فَقَالَ النَّبِىُّ صلى الله عليه وسلم انْظُرُوا هَلْ لَهُ مِنْ وَارِثٍ. قَالُوا لاَ. قَالَ فَادْفَعُوهُ إِلَى بَعْضِ أَهْلِ الْقَرْيَةِ. وَهَذَا حَدِيثٌ حَسَنٌ.
A freed slave of the Prophet, peace and blessings of God be upon him, fell from the foliage of a date palm and died. The Prophet, peace and blessings of God be upon him, said, “find out if he has any heirs” “No,” they replied. He said, “Then distribute his inheritance to some of the people of the city.” (1)
(1): The Prophet, peace and blessings of God be upon him, did not receive the inheritance himself, as prophets, peace and blessings of God be upon them, neither inherit, nor are they appointed as heirs.
