Sunan at-Tirmithiy كتاب الزكاة باب ما جاء من تحل له الصدقة من الغارمين وغيرهم

حَدَّثَنَا قُتَيْبَةُ حَدَّثَنَا اللَّيْثُ عَنْ بُكَيْرِ بْنِ عَبْدِ اللَّهِ بْنِ الأَشَجِّ عَنْ عِيَاضِ بْنِ عَبْدِ اللَّهِ عَنْ أَبِى سَعِيدٍ الْخُدْرِىِّ قَالَ أُصِيبَ رَجُلٌ فِى عَهْدِ رَسُولِ اللَّهِ صلى الله عليه وسلم فِى ثِمَارٍ ابْتَاعَهَا فَكَثُرَ دَيْنُهُ فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم تَصَدَّقُوا عَلَيْهِ. فَتَصَدَّقَ النَّاسُ عَلَيْهِ فَلَمْ يَبْلُغْ ذَلِكَ وَفَاءَ دَيْنِهِ فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم لِغُرَمَائِهِ خُذُوا مَا وَجَدْتُمْ وَلَيْسَلَكُمْ إِلاَّ ذَلِكَ. قَالَ وَفِى الْبَابِ عَنْ عَائِشَةَ وَجُوَيْرِيَةَ وَأَنَسٍ. قَالَ أَبُو عِيسَى حَدِيثُ أَبِى سَعِيدٍ حَدِيثٌ حَسَنٌ صَحِيحٌ.
A man 's debt increased at the time of the Messenger of God, peace and blessings of God be upon him, after fruits he had bought [as merchandise] perished. The Messenger of God, peace and blessings of God be upon him, said, 'Give him charity'. So people gave him charity, but that was not enough to pay off his debts. Hence the Messenger of God, peace and blessings of God be upon him, told his creditors, 'Take all you find and [do] nothing more (1).'"
(1)The debts of a person in bankruptcy are not written off. Creditors give the debtor time to make more money and pay off the remainder of the debt; they are not allowed to harm him or jail him as he was declared bankrupt.
