Sunan at-Tirmithiy كتاب البيوع باب ما جاء فى المصراة
حَدَّثَنَا أَبُو كُرَيْبٍ حَدَّثَنَا وَكِيعٌ عَنْ حَمَّادِ بْنِ سَلَمَةَ عَنْ مُحَمَّدِ بْنِ زِيَادٍ عَنْ أَبِى هُرَيْرَةَ قَالَ قَالَ النَّبِىُّ صلى الله عليه وسلم مَنِ اشْتَرَى مُصَرَّاةً فَهُوَ بِالْخِيَارِ إِذَا حَلَبَهَا إِنْ شَاءَ رَدَّهَا وَرَدَّ مَعَهَا صَاعًا مِنْ تَمْرٍ. قَالَ أَبُو عِيسَى وَفِى الْبَابِ عَنْ أَنَسٍ وَرَجُلٍ مِنْ أَصْحَابِ النَّبِىِّ صلى الله عليه وسلم.
The Prophet, peace and blessings of God be upon him, said, "Whoever buys a dairy animal that had been left un-milked (intentionally) (1) may choose - upon milking it (2)- to return it; and should then return a ṣā'(3) of dates along with it(4)."
(1) Some merchants do not milk their milch animal for some time so that the udder swells, to deceive people into thinking that it has a greater milking ability. This act has been prohibited by the Prophet, peace and blessings of God be upon him, in another ḥadīth. (2) The next time the animal is milked, the true level of its ability to produce milk will be apparent to the new owner. (3) ṣā' is a dry measure equivalent to four mudūd (2600 grams approx.). (4) The dates are in return for the milk he has milked, since if he has chosen to return the animal.
