Sunan at-Tirmithiy كتاب الفرائض
The wife of Sa'd Ibnur-Rabī' came with her two daughters from Sa'd to the Messenger of God, peace and blessings of God be upon him. She said, "Messenger of God, these are Sa'd Ibnur-Rabī''s two daughters. Their father was martyred when he was with you on the day of Uḥud and their paternal uncle has taken their property without leaving anything for them. They cannot get married unless they have some property." He replied, "God will be the judge in this [matter]." So the verse about inheritance was revealed, the Messenger of God, peace and blessings of God be upon him, sent for their paternal uncle and said to him, "Give Sa'd's daughters two thirds [of his property], their mother one eighth, and what remains is yours." A freed slave of the Prophet, peace and blessings of God be upon him, fell from the foliage of a date palm and died. The Prophet, peace and blessings of God be upon him, said, “find out if he has any heirs” “No,” they replied. He said, “Then distribute his inheritance to some of the people of the city.” (1) Footnotes: (1): The Prophet, peace and blessings of God be upon him, did not receive the inheritance himself, as prophets, peace and blessings of God be upon them, neither inherit, nor are they appointed as heirs. ‘Umar said, “Paternal relatives [of the killer] are to pay off the blood money; and the wife [of the victim] does not inherit anything from her husband's blood money.” Aḍ-Ḍaḥḥāk Ibn-Sufyān al-Kilābī told ‘Umar that the Messenger of God, peace and blessings of God be upon him, had written to him, [instructing him] to let the wife of Ashyam aḍ-Ḍibābī inherit a share from her husband's blood money. The Messenger of God, peace and blessings of God be upon him, said, “The wealth of a freed slave (1) is inherited by the heirs [of his emancipator] (2).” Footnotes: (1) i.e. if he passes away leaving behind no family. (2) i.e. when the emancipator is no longer alive. The inheritance is only distributed among the male paternal relatives of the emancipator, not the females.
